PAYMENT SELECTION TERMS & CONDITIONS By making payment of One Hundred and Ninety-Nine ($199.00) Dollars, as either a “Donor” or a “Subscriber”, I do allow for my business name to be listed on the website named “THEBESTOFUS.BIZ or any of its affiliated community site names, as a supporter, and do hereby agree to the following terms and conditions. 1. The business listing provided by “THEBESTOFUS.BIZ” and/or any of its affiliated names and/or community named sites (e.g., THEBESTOF (your community name).Biz) is a service provided by “THEBESTOFUS.BIZ” for a variety of fundraising beneficiary organizations. The listing of myself and/or company is to lend its encouragement to a localized effort in support of the above named community’s youth. We support the beneficiary organization we make payment on behalf and this ongoing effort to enroll the local youth in the “Start Something” program—the corporate mission of “THEBESTOFUS.BIZ.” 2. We do not personally expect a direct endorsement from “THEBESTOFUS.BIZ” or its corporate entity (Bartica Holdings, Inc.—hereinafter referred to as the “corporate entity”). 3. We agree to hold “THEBESTOFUS.BIZ” its corporate entity(s) and/or all of its affiliated names and/or website properties and the beneficiary organization harmless from any liability which may occur as a result of our being listed as a supporter, provided there is not evidence of a deliberate action taken by “THEBESTOFUS.BIZ” or its corporate entity(s) and/or any of its affiliated names and/or website properties or the beneficiary organization to cause our business financial harm or ill-repute. 4. We understand and agree to the provision that the “THEBESTOFUS.BIZ” or corporate entity or beneficiary organization, through its above affiliated name or any of its parties, makes no promise as to location of my business listing on said “supporter’s website” named above, other than it will be featured under the correct community. 5. We understand that the “The Best Of Us Pledge” posted on said website(s) is an acknowledgment of our intent to make a good faith attempt to inform our local youth of the opportunities available by their joining the “Start Something” program; and in no way are we authorized to speak for said program or represent our business as an authorized entity of said “Start Something” program or in any way affiliated with the “Start Something” program (Note: All membership/sign-up information shall be provided to said community youth by the “Start Something” program directly upon the youth’s online sign-up at: http://startsomething.target.com). Our aim, as it relates to the “Start Something” program, is to encourage our local youth in a positive direction. 6. We understand that, as supporters, we may permit a link to our company website (provided said site does not offer or exhibit any non-family oriented materials for viewing) to be used. 7. We agree that, notwithstanding our financial commitment to the beneficiary organization and “THEBESTOFUS.BIZ” mission (i.e., to enlighten and support the local youth and familiarize them with the “Start Something”™ program), we do not surrender or waive our right to promote, support, endorse and/or financially underwrite any other similar mission/cause without the permission of or notice to “THEBESTOFUS.BIZ” and its corporate entity, affiliates or the beneficiary organization prior to doing so. The above sections are the extent of our understanding between our entity and “THEBESTOFUS.BIZ” and its corporate entity and the beneficiary organization regarding our participation as a business listed within the above named site. All trade names, service marks and copyrights of each entity mentioned herein are hereby recognized and respected as solely owned by said entities.
